Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern your access to and use of the Energy Mind platform and services ("Service") operated by Energy Mind ("we", "us", "our"), developed in association with Aston University, Birmingham, United Kingdom.

By registering for an account you confirm that you are authorised to accept these Terms on behalf of yourself or your organisation, and that you agree to be bound by them. If you do not agree, do not register or use the Service.

These Terms are governed by the laws of England and Wales.

2. The Service

Energy Mind provides a cloud-based platform for commercial and industrial organisations in the United Kingdom to:

  • Upload and analyse half-hourly electricity and gas consumption data
  • Verify utility bills and identify cost anomalies
  • Estimate carbon and emissions performance
  • Generate equipment and energy efficiency recommendations
  • Produce downloadable energy audit reports
  • Use optional AI-assisted features for data extraction and report narrative generation

The Service is provided for informational and analytical purposes only. Nothing in the Service constitutes professional energy consultancy, legal, financial, or regulatory advice.

3. Accounts and eligibility

  • You must be at least 18 years old and have authority to act for your organisation.
  • You must provide accurate and complete registration information.
  • One email address may only be used for one account.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • Notify us immediately at [email protected] if you suspect unauthorised account access.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable UK law
  • Upload data you do not have the right to share (e.g. third-party metering data without authorisation)
  • Attempt to gain unauthorised access to other users' accounts or data
  • Reverse-engineer, decompile, or extract source code from the platform
  • Use automated means (bots, scrapers) to access the Service without our written consent
  • Transmit malware, spam, or any content that is harmful, defamatory, or infringing
  • Resell, sublicense, or make the Service commercially available to third parties

5. Your data

You retain ownership of all data you upload to the Service ("Your Data"). By uploading data, you grant us a limited licence to process it solely to provide the Service to you.

You are responsible for ensuring that Your Data does not infringe any third-party rights and that you have obtained all necessary permissions to share it (including from meter operators or energy suppliers where applicable).

We handle Your Data in accordance with our Privacy Policy, which forms part of these Terms.

6. AI features

Certain features, including bill data extraction from PDFs and AI-generated report narratives, use large language models provided by OpenAI. When you use these features:

  • Relevant content from your uploads is sent to OpenAI's API for processing.
  • AI-generated outputs are provided as a convenience and may contain errors or inaccuracies.
  • You are responsible for verifying AI-generated outputs before relying on them.
  • We are not liable for decisions made on the basis of AI-generated content.

7. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Energy Mind and its licensors and is protected by UK and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during the term of these Terms. All other rights are reserved.

Reports and outputs generated by the Service from Your Data belong to you.

8. Availability and modifications

We aim to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time with reasonable notice where possible.

9. Disclaimer of warranties

The Service is provided "as is" and "as available"without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be error-free, meet your requirements, or that analytical outputs will be accurate, complete, or fit for any particular regulatory purpose (including ESOS, SECR, or other compliance obligations).

10. Limitation of liability

To the fullest extent permitted by English law:

  • Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed £500 or the amount paid by you in the 12 months preceding the claim, whichever is greater.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

11. Termination

You may terminate your account at any time by going to Settings and selecting Delete account. We may suspend or terminate your access if you breach these Terms, with notice where reasonably practicable.

On termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to these Terms

We may revise these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms and any disputes arising from them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, without prejudice to your right to bring proceedings in the courts of your place of residence if required by applicable consumer protection law.
